Fonteera accused of Sanlu cover-up


Convicted Sanlu boss blames Fonterra
The chairwoman of the Chinese dairy company that sold fatally contaminated infant milk formula says she acted on information supplied by Fonterra. Former Sanlu chairwoman Tian Wenhua, 66, sentenced last week to life in prison, says a Fonterra-appointed director gave her a document stating the European Union's permitted levels of the industrial chemical melamine. Fonterra chief executive Andrew Ferrier confirmed to the Herald yesterday that Tian had been given a document by a Fonterra board member. China's state news agency, Xinhua, has reported that Tian intends to appeal against her conviction for producing and selling false or substandard products. Three other company executives received 15, eight and five-year sentences respectively. Two men were sentenced to death. Xinhua said rather than stopping production of tainted products after the contamination was confirmed on August 1 last year, Sanlu decided to limit melamine levels to within 10mg for every kilogram of milk. "Tian said during her trial that she made the decision not to halt production of the tainted products because a board member, designated by New Zealand dairy product giant Fonterra that partly owned Sanlu Group, presented her a document saying a maximum of 20mg of melamine was allowed in every kg of milk in the European Union," Xinhua said. "She said she had trusted the document at that time." Mr Ferrier told the Herald a Fonterra representative had given Tian the document soon after the board was advised of the contamination on August 2.

Doesn’t this get more and more filthy, Fonteera hide the contamination during the Beijing Olympics and the story was only forced to the top when Helen Clark forced it out into the open, at no time did Fonteera take leadership on this issue and we now hear a claim that Fonteera advised Sanlu that the acceptable amount for an adult was 30mg of melamine per kilo and the actual amount found was 2563mg/kg. So Sanlu certainly followed the advice, the question was did Fonteera mean for that advice to be followed or was it given as a scramble of information once Fonteera understood the size of the issue and simply sent it as a package? There has to be an inquiry now.

But I cannot believe that Fontera would sabotage themselves by doing all this. Seriously, what would be in this for them to tell their Chinese counterparts "yep, you heard us right: We want you to start poisoning the milk. No publicity is bad publicity and what could get us in the news quiocker then thousands of dead and dying babies?"

It just doesn't make sense.

I think that Fontera got gooched by the dodgy bastards at San lu, trying cut corners.

I'm not for one second suggesting that Fonteera intentially suggested to Sanlu that they limit melamine to 30mg/kg, I think they threw a whole lot of info at Samlu and because their management of this relationship left a lot to be desired in the first place, Sanlu decided to adopt a position that wasn't intended and backed it up with the report from the EU. It is another example of the poor relationship Fonteera created.

No they didn't.
They gave sanlu info on allowed malamine levels as issued by the UN.

Perhaps the UN is liable as they have set the melamine guidelines, thereforwe they know melamine will be used in food.

Just because they supplied the information doesn't mean they allowed sunlu to break said guidelines.

The from the EU says a maximum of 20mg of melamine was allowed in every kg of milk. The actual level of contamination was 2500mgs per kilo of milk.

For anyone to try and claim that an EU document saying the MAXIMUM allowable level of 20mg melamine per kg somehow justifies San Lu adding 2500mg per kg is utterly preposterous.

This bitch is trying to cover her arse big time. She is a "party" member and the Party is doing it's level to blame this disgrace on the evil foreign devils.

..they had a discussion about Melamine for Gods sake ... its like having a conversation in a lolly factory where one of management is asking how much arsenic is safe to put in lollies ... and then not following up on it or reporting the conversation.

We're talking about milk powder used in INFANT FORMULA. They had a conversation/meeting about a poison and then did nothing !! beggars belief .

Probably the biggist issue is that China & (In)fanterror are both corrupt monopolies with no moral compass, or strong independant regularly bodies to interven in their actions.

It is quite disturbing how many NZers are falling over themselves to put the boot into Fontera based on the accusations of the woman who has already been sentenced to life in the slammer and trying to save herself.

Fonterra are more than mere investors, they gave advice, they are directors.
The best they can hope for is to be seen as negligent, criminally negligent is yet to be decided.
By Fonterras own admission they handed a report that said poison could be put into milk and be safe!

Guilt comes in many forms. This issue is guilt through association, and failing to take steps to eliminate Melamine from being added to ANY milk or related products when they KNEW it was happening. Fontera chose to look the other way and cover their ass when they knew it was going on to begin with. It would have hurt their returns had they opened their mouths earlier. Share holder returns are much more important than Human Welfare! Yeah-right!

How the fuck can you be guilty by association if you didn't intend the act therefore lacking the required mens reas to commit a criminal act.

1. Fontera knew that Sanlu was putting Melamine in the milk Powder, and they failed to act on their knowledge until it blew up in their face with the deaths and thousands of affected infants in China.
2. Fontera also witheld their knowledge to the levels that Melamine was being used in the EU products as well. They turned a blind eye and remained silent with their knowledge. The financial returns were obviously more important to them than the safety of the Consumers. Maybe the Fontera Shareholders should take this under consideration when appointing Sr. Managers that risk their entire market existence for the few extra dollars that their silence brought in!
It's stupid risks like this that sink entire Industries and economies. Fontera are a Monopoly Player here in NZ with more than the Lions share of Dairy Contracts for supply. If they go down - the entire Dairy Industry in New Zealand goes down with them. Gee imagine that - I wonder if they would ask John Key to bail them out with our tax dollars?

Both scenario's make them guilty through their association and ownership shareholding with Sanlu. It sounds quite clear to me that they have to accept liability for their inactions in this case.

So remind me again what section of the crimes act guilt by association comes under.

Um no wrong again. There are only a few instances where someone can be held guilty by omission such as where the accused owes the victim a special duty of care like a parent child relationship and this is not one of them.

It is guilt as Directors, giving advice, and failing to act when they knew the product was contaminated.
How many weeks/months did they delay and how many deaths did their inaction and negligent directorship has caused.
